The principle area of Kent Bailiff and Enforcement Services work is recovering commercial rent arrears on behalf of landlords, property companies and managing agents.

We offer a free service to our clients( most cases), and, without the need for any court process/litigation (under the distress for rent act 1988 ) our fully certificated and bonded bailiffs. Upon your written instruction, immediately attend the premises to collect the arrears or as a last resort remove and sell goods and effects (very few cases).

We endeavour to make a visit to the property the same day or within 24hrs of receiving your written instruction (our Warrant to Distrainwarrant_to_distrain.pdf), and throughout the process you will be kept up to date, and in the case of removals, they will only be carried out with your consent.

Protective Distraint  

If a tenant owes rent, there is a good possibility that he will also be in arrears with business rates, taxes and suppliers. Protective Distraint is a procedure wherein the tenants ( in arrears )assets  are seized and held under agreement, allowing him to continue to trade , but giving the landlord 1st claim/entitlement to the assets should a 3rd party attempt to seize and sell (Distrain) under their court order.

Forfeiture of Lease

Kent Bailiff and Enforcement Services can assist the Landlord exercise his right to regain possession of his property without the need for court action/litigation and against the wishes of his tenant.

With most commercial leases the landlord has the right to terminate if the rent is either in arrears longer than a specified period or if in breach of other covenants within the lease.

Upon the landlords instructionAuthority_to_Effect_Forfeiture.pdf, a fully bonded and certificated bailiff will effect forfeiture by peaceful entry to the premises. A full inventory along with any photographic evidence taken and then the property will be secured along with a change of locks carried out by a qualified locksmith. Finally termination notices are fixed in place advising all parties to the action taken.

 

Forfeiture of Lease would normally be carried out in cases where distraint (the seizure and sale of goods) is not an option, for example where entry to the property has been denied or cases where no goods and effects exist (poor value or 3rd party ownership).
